Construction stormwater comments close September 17: check which permit applies

EPA’s extended comment deadline is September 17 for its proposed 2027 construction permit. Builders should distinguish that proposal from the permits currently governing their own projects.

Builders have until September 17 to comment on EPA’s proposed 2027 Construction General Permit. The agency’s current notice explicitly replaces the original September 2 deadline with the extended date. The proposal was published August 3; it is not a new permit already in force.

The deadline is receiving fresh industry attention. In a September 15 report, the National Association of Home Builders described taking a Small Business Administration advocacy official to Northern Virginia construction sites to discuss stormwater requirements in practice.

Start with the permitting authority

EPA says the proposed permit concerns areas where it is the National Pollutant Discharge Elimination System permitting authority. Do not assume that a federal proposal automatically changes a state-issued permit. The agency’s proposal page links the draft permit, coverage appendix, fact sheet and comment docket, EPA-HQ-OW-2025-0760.

For a builder or remodeler considering a response, identify the exact provision and explain how it would affect a real work sequence. Separate a concern about implementation from a request to change the requirement. Keep examples specific enough to explain the issue without disclosing a customer’s private information.

What a homeowner can ask now

If a project involves site disturbance, ask who is responsible for determining the applicable stormwater requirements. The proposal’s existence is not an answer to that question. Request an explanation of which approvals govern the actual job and who maintains the associated records.

Discuss responsibility for temporary controls, inspections and changes during construction. Where several companies will work on the site, establish a single point of contact for questions about access, staging and protection of neighboring property. These are planning questions, not a finding that every home renovation needs the same permit.

Before relying on a deadline, consult the current EPA notice and docket. A proposal can change before adoption, and public comments do not themselves amend a project’s existing obligations. Keep the current permit and the proposed future requirements in separate parts of the project file so the team can track what applies today and what it is monitoring.
